What’s Going on in the Courts?

Delegates to the local judicial conventions in New York City have just met, in secret, like the “Founding Fathers” who authored the U.S. Constitution in Philadelphia. Until November 2, Blacks will be clueless as to the judicial nominations to the New York Supreme Court, the general trial court in New York, whose jurisdictions include, inter alia, felony prosecutions for the prison-industrial complex.
An endorsement from the Democratic Party is a virtual guarantee of getting a judicial plum. The Supreme Court tenure is for fourteen years with a generous retirement plan. Power is built from the basement to the roof. Black leaders, on the other hand advocate the trickle down theory. Judges will make more personal decisions about our lives than any mayor, governor or president.
While we are building from the top to the bottom, many of these justices will be wreaking havoc in the Black and Latino communities despite a state chair of the Democratic Party who is a person of African ancestry and a majority of the Democratic, county chairpersons in New York City who are either Black or Latino. Because politics practices trick or treat, the election should have been scheduled for October 31.
Robert Morgenthau seems to have been the District Attorney of New York County for time immemorial. To be sure there should be a serious challenger to his prosecutorial authority. Unfortunately, the choice in 2005 may be between jumping from the skillet (Morgenthau) into the fire (former Acting Manhattan Supreme Court Justice Leslie Crocker Snyder).
Crocker now works for NBC-TV trashing people like Kobe Bryant who shifts between being an NBA star and a police snitch. NBC unlawfully aired nude, hospital photos of Tawana Brawley. Snitching is a byproduct of slavery and it is certainly a job requirement for being Black leaders and most Black inmates are in prison because of their tongues.
The price for not being a snitch is to lose your livelihood. A Black person who refuses to snitch must be either insane or dangerous in the mind of a white supremacist. Blacks do more harm to themselves and to their people with their tongues than any other part of their bodies. Ears are the least used parts of our bodies.
While the Central Park jogger defendants were being railroaded by Morgenthau, you can bet your last dollar that Snyder was philosophically in cahoots with Linda Fairstein who is also receiving rewards through publishing novels and legal consulting for railroading Black men like the Central Park jogger defendants. The prison industrial complex takes care of its own.
Crocker, unlike Morgenthau, vigorously supports the state-sponsored execution of Black men. She also wants to establish a terrorism unit in the district attorney’s office to combat terrorism. Like the War on Drugs and the War on Poverty, the War on Terrorism is a War on Blacks.
Although she is retired from the bench, a five-judge panel of the Appellate Division, First Department recently chastized her for systematically excluding Hispanics from a jury. Batson v. Kentucky requires state trial courts to watch and sanction prosecutors who use their peremptory challenges in a purposeful and racially-discriminatory fashion.
Crocker has already raised a war chest of more than $500,000 to challenge Morgenthau who, on the other hand, has raised only $282,475. Her law firm, Kasowitz, Benson, Torres & Friedman has contributed $300,000 to her prospective race. Money buys access to politicians who represent special interests rather than constituents.
Although Morgenthau limits contributions to $5,000, Donald Trump made a $10,000 contribution to his campaign. Crocker refuses to apply any brakes to fund-raising. In the end, you can bet the house that Wall Street will fashion a bail out plan for Morgenthau. The status quo will remain intact for another four years.
