Re: Demand for the arrest of Jeffrey Wiesenfeld
Dear Mr. Morgenthau:
The United African Movement, a vanguard human rights organization for more than two decades, demands the immediate arrest of Jeffrey Wiesenfeld for engaging in criminal conduct amounting to violations of state laws against disorderly conduct and harassment at a groundbreaking ceremony today at Borough of Manhattan Community College.
Councilman Charles Barron was speaking at the podium to an audience when Wiesenfeld interrupted his speech with the intent to place him in reasonable fear of physical injury and to seriously annoy him. No lawful reason justified Wiesenfeld's misconduct. He has reportedly referred to Blacks as "savages."
Wiesenfeld asserted that Barron's body language, near a high-ranking school official, was reminiscent of a "thug." A television reporter described Wiesenfeld's conduct as engaging in "heckling." His conduct, to be sure, disturbed a lawful assembly. It must be the subject of a criminal prosecution.
Yesterday, Kathy and Dominique Sharpton were arraigned in Manhattan Criminal Court for allegedly using profanity while they were detained for a traffic infraction. This conduct, under the First Amendment, landed them in handcuffs and they were reportedly detained in handcuffs at a local precinct for two hours.
If Wiesenfeld is not immediately arrested for his criminal conduct at BMCC, it will confirm that New York operates a Jim Crow judicial system. A blue-ribbon commission, in April 1991, issued a report asserting that this state's criminal justice system is "infested with racism." This condition is festering in 2009.
The Sharptons may face up to a year in jail for exercising First Amendment rights while Wiesenfeld is enjoying immunity for interrupting an official ceremony involving high-ranking public officials including Mayor Michael Bloomberg. Scores of students were also present.
This is reminiscent of treatment that Black public officials suffered during Reconstruction. We are witnessing the emergence of the Second Reconstruction with offices of district attorney aligned with white supremacists groups. Alexander H. Garland, who had committed treason by joining the Confederate States of America, became the Attorney General of the United States.
This arrest must happen forthwith.
