Dear Cong. Conyers:
On June 21, 2007, at approximately 6:00 p.m. in Brooklyn, members of the New York Police Department, acting under color of New York law, viciously, senselessly and wrongfully beat a young, handcuffed, Black man. This beating occurred in the infamous 77th Precinct which was also a subject of the 1983 Congressional Hearing on Police Brutality.
While driving near the crime scene, the Warrens witnessed a crime in progress. When they informed the police assailants that they were witnesses rather than spectators, another crime scene was created and criminal intent was transferred to the Warrens. Under New York’s slave code, Blacks were incompetent to testify against whites. This is now customary law.
The badges of slavery are alive and well in New York. Under N.Y. Penal Law § 215.10 et. seq., tampering with a witness is a crime and under N.Y.P.L. § 215.15 et. seq., intimidating a witness is also a crime. The Warrens were witnesses. If they had been white, they would be entitled to protection under New York law.
Instead, the District Attorney of Kings County has expressed an intention to prosecute attorney Michael Warren for obstructing governmental administration and resisting arrest. Attorney Evelyn Warren will be prosecuted for disorderly conduct. If Warren is convicted of obstructing governmental administration, he will be automatically disbarred from the practice law.
During this criminal transaction, attorney Michael Warren was repeatedly beaten about his head. Attorney Evelyn Warren was hit in her face. Both received serious physical injuries while no member of the NYPD received an injury except, possibly, their knuckles.
The NYPD is an arm of the five district attorneys offices in New York City. These district attorneys’ offices use their prosecutorial authority to cover-up the crimes of the NYPD. The assassination of Sean Bell is a work in progress. In the case of the Warrens, the Kings County prosecutor’s office has received the baton from the NYPD.
Congress must take immediate action to preclude a miscarriage of justice. Among other things, Congress must call on the Justice Department to initiate civil rights prosecutions under 18 U.S.C. §§ 241 and 242 against appropriate members of the NYPD and the Kings County district attorney’s office. The right of Blacks to testify against white people should be a fundamental, civil right.
Congress must also reopen the 1983 Congressional Hearing on Police Brutality. Attorney Michael Warren was a key participant in that hearing. He was one of three attorneys for the estate of Michael Stewart. He died amid those hearings. Eleven white member of the New York Transit Police Department fatally beat Stewart, a descendant of enslaved Africans, near a subway station for kissing a Caucasian female.
